2 Accounts

Cortex Chat is usable without an account. An account is required for saved conversations, for higher limits, and for the developer services.

You are responsible for the credentials on your account and for everything done with them. You must be at least [À REMPLIR PAR MATHIS : âge minimum, à confirmer, 16 par défaut sous RGPD] years old, or the age of digital consent in your country if that is higher, to hold one. Provide accurate information and keep it current. One person, one account; sharing credentials is a breach.

We may suspend an account to protect the service or other users, and we will tell you why unless the law forbids it.

3 Acceptable use

Use the services as they are documented, within the limits published on the Pricing page, and without attempting to make them do something other than what they do.

You keep responsibility for what you send and for what you do with what comes back. An output from these models is a draft produced by a statistical system; it is not verified, and it is not advice. See the AI disclosure.

4 Prohibited uses

You must not use a Cortex service to:

• break the law, or help someone else break it;
• develop or deploy a weapon, or any system whose purpose is to cause physical harm;
• produce sexual content involving minors, or content that sexualises or endangers a minor in any way;
• generate content designed to defraud a specific person, or to impersonate one without disclosure;
• build a system intended to make decisions about people's access to employment, credit, housing, healthcare, education or essential public services without qualified human review;
• attempt to obtain another user's data, or to defeat an access control;
• probe, scan or overload our infrastructure, or that of a third party, without written permission;
• train a competing model on our outputs, where the model card or the service terms forbid it;
• strip or falsify a provenance marker, a watermark or a model identifier.

This list is not exhaustive. We may act on conduct that is not written here if it endangers the service or its users, and we will say so when we do.

5 Rate limits, quotas and fair use

Every service applies a rate limit. The published limits are on the Pricing page and in the documentation; the current value always prevails over a value quoted anywhere else, including in this document.

Limits exist so that one workload cannot remove capacity from everyone else. We may throttle, queue or temporarily refuse requests that exceed them. We do not silently break a running request: a request that cannot be served returns an error that says so.

Free access may be modified or withdrawn. Paid access follows the pricing terms in force on the day of purchase.

6 Ownership

You retain all rights to the content you submit. Cortex Foundation acquires no ownership of your inputs and no ownership of your outputs.

We claim no rights over the models we publish beyond the terms of their licences. The Cortex name, the wordmark and the site design remain ours.

Where you send us feedback, a bug report or a research note, you grant us the right to use it without obligation, and we will credit you unless you ask us not to.

7 Termination

You may stop using the services at any time and delete your account from your account settings. Deletion removes your account data within the periods stated in the Privacy policy.

We may suspend or terminate your access for a material breach of these terms, for non-payment, or where the law requires it. Where the breach is serious, suspension takes effect immediately. In every other case we give notice and a reasonable opportunity to comply.

Sections that by their nature survive termination — ownership, warranties, liability, governing law — survive it.

8 Warranties and disclaimers

The services are provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the services will be uninterrupted, that they will be free of error, or that an output will be accurate, complete or fit for the use you intend. We publish evaluations precisely because we do not want you to take this on trust; read them, and read the limits they state.

Cortex CLI, Cortex Code and Cortex Security are developer tools. They act on files and systems you point them at. You are responsible for the repository, the credentials and the environment you give them.

9 Limitation of liability

To the fullest extent permitted by law, Cortex Foundation is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost data or business interruption, arising from your use of the services.

Our total liability for all claims relating to the services is capped at [À REMPLIR PAR MATHIS : plafond de responsabilité — par exemple les montants payés au cours des douze derniers mois]. Nothing here excludes liability that cannot be excluded by law.

Where the services are provided free of charge, they are provided without any commercial commitment as to availability.

10 Governing law and jurisdiction

These terms are governed by the law of [À REMPLIR PAR MATHIS : droit applicable, par exemple « the laws of France » ou « the laws of the Netherlands »], without regard to its conflict-of-laws rules.

The courts of [À REMPLIR PAR MATHIS : juridiction compétente] have exclusive jurisdiction, without prejudice to any mandatory consumer protection rule that gives you the right to bring proceedings where you live. Where you are a consumer in the European Union, you may also use the national consumer mediation scheme available in your country.

11 Changes to these terms

We may change these terms. A material change is announced on this page, with a new "last updated" date, at least [À REMPLIR PAR MATHIS : délai de préavis, 30 jours par défaut] before it takes effect. Where the change is material and you hold an account, we also notify you by e-mail.

Continued use after the effective date is acceptance. If you do not accept a change, stop using the service before that date and, where a paid subscription is involved, ask for a pro-rata refund.
